What is happening to Acupuncture?

​The right of Texas chiropractors to perform chiropractic acupuncture is under assault. Currently, the Texas Association of Acupuncture and Oriental Medicine (TAAOM) is suing the Texas Board of Chiropractic Examiners to contest the board’s rules regarding acupuncture. The trial will take place in late August 2023 in the Travis County District Court.

​The Texas Chiropractic Association joined the lawsuit as an intervenor. Here’s why and what’s at stake:

• TAAOM is questioning the qualifications and training of chiropractors, who must complete at least 100 hours of training in acupuncture – on top of their already extensive education and training. TAAOM argues that chiropractors performing acupuncture is a public health risk, even though chiropractors have safely performed acupuncture in our state for decades without any issues, long before TAAOM even existed. They are calling into question the credentials of chiropractors who are well-trained in this area.​
• Suddenly, TAAOM is contending that an acupuncture needle is “incisive,” which would exclude chiropractors from the procedure. But the Acupuncture Chapter of the Texas Occupations Code defines an acupuncture needle as “nonincisive,” so TAAOM’s position is contrary to its own statute.
• A successful challenge by TAAOM of the board’s acupuncture rules could open the door for future challenges of TBCE rules by other groups and potentially limit the rights of Texas chiropractors.

Quite simply, this isn’t a public health issue. TAAOM is engaged in a turf war, and this case is the latest example of anticompetitive behavior against chiropractic. If you have an acupuncture permit in Texas, your rights are being threatened. Even if you don’t offer acupuncture in your practice, you should care as it’s an overarching issue impacting your profession.
