Summary of TBCE May 17, 2016

A regular meeting of the Texas Board of Chiropractic Examiners (TBCE) was held May 17, 2016, in Austin. The following is a summary of Board actions taken during this meeting.

The Board voted to adopt amendments to the following rules - effective September 1, 2016:

  • Rule 78.6 - The amendment deletes an obsolete reference to aprofessional fee which is no longer imposed as a result of HB 7 passed under the 34th Legislature and to require application of any monetary funds received by the Board to outstanding balances.

  • Rule 78.8 - The amendment removes the requirement for a 120 day hearing that is not necessary for compliance with the Administrative Procedure Act (APA) and to permit notifications of decisions and orders by electronic means sent to the current e-mail address or tele-copier, upon agreement of the respondent’s representative or the respondent, if not represented by counsel.The Board voted to propose (for comment) the following amendments to the rules:

  • Rule 72.6 - The proposed amendment reflects the Board’s most current practices in giving examinations.

  • Rule 78.6(a) - The proposed amendment updates the rule to reflect and ratify the present fee for the TBCE’s jurisprudence examination.

  • Chapter 74 - Board Staff has published notice of rule review for Chapter 74 pursuant to the Government Code §2001.039 in order to ensure consistency with the law and reach a determination of present need for the rule.

  • Rule 74.1 – The proposed amendment is part of the Board’s review ofChapter 74 to fulfill its ongoing duty to conduct agency rule review.

  • Rule 74.2 - The proposed amendment is part of the Board’s review of Chapter 74 to fulfill its ongoing duty to conduct agency rule review and also reflects the transfer of administration duties from the Department of State Health Services (DSHS) to the Texas Medical Board (TMB) asrequired by Senate Bill 202.
